Terms of service
These terms are an agreement between you and RBO Build (ABN 62 353 202 882) ("we", "us"), Melbourne, Victoria, Australia, for using RBO Build: the platform at app.rbobuild.com.au, the websites we host and the related services. By creating an account or using the service, you agree to them. If you use RBO Build for a business, you agree on its behalf.
1. The service
RBO Build lets members plan, build, host and look after websites for small businesses with the help of AI, including domains, SEO tools, website health checks, contact forms, client dashboards and client payments. We improve the service over time and may change or remove features; if a change significantly reduces what your plan includes, we'll tell you beforehand.
2. Accounts
- You need to be at least 18, and give accurate details.
- Keep your password safe. You're responsible for what happens in your account.
- Members can invite clients (the businesses they make websites for) to their own login and decide what each client can see and do. Members are responsible for who they invite.
3. Plans and billing
- Plans are billed in advance, monthly or yearly, in Australian dollars. Each plan includes a number of websites and AI edits; websites beyond your plan cost the extra-website price shown for your plan.
- Payments are processed by Stripe. If a payment fails, we'll let you know and try again; if it stays unpaid, we may pause your websites until it's paid.
- If we change prices, the new prices apply when you join or change plan, and we'll give existing members at least 30 days' notice before any change to what they pay.
- You can change plan or cancel at any time in Plan and billing. A cancellation takes effect at the end of the period you've paid for; we don't refund part months, except where the law requires.
- Discount codes apply as described when they're given, and can't be exchanged for cash.
4. Your clients and client payments
- You set your own prices for your clients and invoice or charge them yourself. We're not a party to your agreements with your clients.
- If you collect payments from your clients through RBO Build, you connect your own Stripe account. The money goes straight to you; Stripe's terms apply between you and Stripe, and you're responsible for your prices, tax, refunds and disputes. We only show the payment's status and Stripe's receipts.
- You may choose to pause a client's website when their payment is overdue. Tell your clients this can happen.
5. Your content and websites
- You (and your clients) keep ownership of the content you give us and of the websites made for you. You give us permission to store, copy, process and publish it only as needed to provide the service.
- You must have the right to use everything you upload or ask the AI to use, including photos, logos, texts and designs, and you're responsible for the websites you publish, including the information on them and each website's own privacy policy and terms.
- You can download a website's files at any time while your account is open. After your plan ends, we keep your websites for a limited time so they can be restored, then delete them.
6. The AI
- The AI writes and designs from what you give it. It can make mistakes: check every page before you publish, including facts, prices, contact details and anything with legal effect.
- The AI is told never to invent reviews, awards, qualifications or other claims. Don't ask it to, and don't publish claims you can't back up.
- A change that fails is never charged, and fixing a mistake the AI made is free, as described in the platform.
7. Domains and email
- Your clients' domains belong to them (or to whoever registered them). Connecting a domain to RBO Build doesn't transfer it to us.
- Enquiries from a website's contact form are sent through the business's own email account, using the settings entered for that website. You're responsible for those settings being correct and allowed by the email provider.
8. Acceptable use
You must not use RBO Build to:
- publish anything illegal, misleading, defamatory, hateful, sexually explicit or harmful;
- infringe anyone's copyright, trade marks or other rights;
- send spam, run phishing or scams, or collect people's information without their consent;
- host malware, attack or overload any system, or try to get around the platform's security or limits;
- resell access to the platform itself (making and selling websites to your clients is, of course, what it's for).
We may remove content or suspend a website or account that breaks these rules. Except in urgent cases, we'll tell you why first and give you a chance to fix it.
9. Availability and support
We work to keep RBO Build and the websites we host running and fast, but we can't promise they'll never be interrupted, for example during maintenance or problems with our providers. Billing and account questions are answered by a person; email info@rbobuild.com.au.
10. Our liability
Our services come with guarantees that can't be excluded under the Australian Consumer Law. For a major failure you're entitled to cancel and receive a refund for the unused portion, or to compensation for its reduced value. Where the law allows, our liability for a failure to comply with a guarantee is limited to supplying the service again or paying the cost of having it supplied again.
To the extent the law allows, we aren't liable for indirect or consequential loss (such as lost profits, lost business or lost data), and our total liability to you in connection with the service is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.
11. Ending the agreement
You can close your account at any time. We may end or suspend your account if you seriously or repeatedly break these terms, or if a payment stays unpaid, after giving you notice where reasonable. When an account ends, its websites go offline; download anything you want to keep first.
12. Changes to these terms
We may update these terms. We'll tell members about significant changes by email or in the platform at least 30 days before they take effect. Continuing to use the service after that means you accept the new terms.
13. General
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If part of these terms can't be enforced, the rest still applies. Our privacy policy explains how we handle personal information.
